By accessing or using CyberAI (the “Service”), you agree to these Terms of Service and any policies referenced here, including our Privacy Policy and Copyright & Licensing. If you do not agree, do not use the Service.
2) Changes to Terms
We may update these Terms from time to time. When we post changes, we’ll update the “Last updated” date below. Your continued use constitutes acceptance of the revised Terms.
3) Accounts & Eligibility
- You must provide accurate account information and keep it current.
- You’re responsible for maintaining the confidentiality of your login and for all activity under your account.
- Unified account. The same CyberAI account credentials apply to the website, courses, tools, and CyberAI VPN. There are no separate VPN-only logins.
- VPN access. Using CyberAI VPN requires a registered account. Guest or anonymous VPN use is not supported—you must complete the standard sign-up process on our website.
- We may refuse service, close accounts, or reclaim usernames at our discretion.
4) Subscriptions, Billing & Refunds
Some features require a paid subscription or one-time purchase. Prices are shown before checkout and may change prospectively. Taxes may apply.
- Renewal. Subscriptions renew automatically until canceled.
- Cancellation. You can cancel anytime; access continues through the current billing period.
- Refunds. Unless required by law or a posted guarantee, payments are non-refundable.
- Trials & Coupons. Trial and promotional terms apply as shown at sign-up.
- VPN included. Paid membership tiers (Starter, Pro, Elite) include access to CyberAI VPN features as described on our VPN page. Device limits and server access may vary by plan.
5) Acceptable Use
When using the Service, you agree not to:
- Resell, rehost, or redistribute content or downloads without a written license;
- Scrape or harvest data at scale, or build datasets from our content;
- Train, fine-tune, or evaluate machine learning models on our content without permission;
- Upload malware, attempt to gain unauthorized access, or disrupt the Service;
- Harass, threaten, or violate the rights of others.
- VPN abuse. Do not use CyberAI VPN for illegal activity, spam, copyright infringement, credential stuffing, unauthorized port scanning, or to circumvent lawful network restrictions.
- No reselling. Do not resell, sublicense, or share VPN access outside your plan’s device limits.
6) User Content & Feedback
If you submit content (posts, code, projects, comments), you grant CyberAI a non-exclusive, worldwide license to host, display, and reproduce that content solely to operate and improve the Service. You retain ownership. Do not submit content that infringes others’ rights or violates law.
You may submit feedback or suggestions; we may use them without obligation to you.
7) AI Tutor, Courses & Educational Guidance
- We continuously improve models and prompts; results may vary.
- Do not input secrets you are not authorized to share.
- You are responsible for how you use generated content.
8) CyberAI VPN
CyberAI VPN includes our desktop application, Chrome extension, and related connection services (collectively, “CyberAI VPN”). By installing or using CyberAI VPN, you agree to these Terms and our VPN privacy practices.
- One account. Sign in with the same email and password you use on the CyberAI website. The app authenticates via short-lived tokens issued while you are logged in on the site.
- Plan requirements. VPN server access, device limits, and premium features depend on your active membership tier. Free accounts may have limited or no VPN connectivity.
- Acceptable use. Use the VPN lawfully and responsibly. We may suspend VPN access for abuse, fraud, or violations of these Terms.
- Availability. CyberAI VPN is provided on an “as available” basis during ongoing development. We do not guarantee uninterrupted connectivity, specific server locations, or protection against all threats.
- Software. VPN client software is licensed, not sold. See our Copyright & Licensing page for permitted use of the apps.
9) Privacy & Security
Our Privacy Policy explains what data we collect and how we use it. We apply reasonable security measures, but no system is perfectly secure. Notify us promptly of any suspected account compromise.
10) Intellectual Property
The Service, content, logos, and underlying technology are protected by copyright, trademark, and other laws. See Copyright & Licensing for permitted use, licensing, and DMCA/notice-and-takedown procedures.
11) Third-Party Links & Tools
We may link to third-party sites or integrate third-party tools. We aren’t responsible for their content, policies, or practices. Use them at your own risk and review their terms.
12) Availability & Changes to the Service
We may modify, suspend, or discontinue features at any time. We strive for high uptime but do not guarantee uninterrupted service. We may throttle or rate-limit abusive or excessive usage.
13) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERAI / MATT JERRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
15) Suspension & Termination
We may suspend or terminate access for any violation of these Terms or to comply with law. You may stop using the Service at any time. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitations, governing law) do survive.
16) Governing Law & Disputes
These Terms are governed by the laws of Alberta, Canada, without regard to conflict-of-law principles. Venue and jurisdiction lie in Alberta courts unless otherwise required by law.
